Justice Nisha M. Thakore upheld the conviction of the impersonator for cheating by personation, while modifying the conviction of the actual candidate from abetment under Section 114 IPC to Section 109 IPC, holding that although he had facilitated the offence by handing over his admit card, he was not present when the offence was committed.
